3. Regulated and Professional Services

CGA operates as a professional consultancy and facilitation organisation.

Any service that legally requires a licence, registration, certification, attestation, audit, professional signature or appearance before a court, tribunal or government authority will be undertaken only by an appropriately qualified and authorised advocate, chartered accountant, company secretary, valuer, auditor, insolvency professional, investment professional or other regulated professional, as applicable.

References to CA, CS, advocate, auditor, certification, legal representation or other regulated services do not imply that CGA itself, or every employee, consultant, associate or empanelled person, possesses every regulatory qualification.

The identity, role and registration details of the responsible professional should be confirmed in the relevant engagement documents.

4. Client-Supplied Information and Financial Documents

Whenever a client provides financial statements, bank statements, invoices, books of account, tax records, identity documents, certificates, declarations, property papers, business information or any other document or data, the information is provided by the client with their full knowledge, authority and responsibility.

The client represents and confirms that all information and documents supplied are accurate, complete, current, authentic, lawful and not misleading.

The client shall be responsible for disclosing all material facts and for obtaining any consent or authority required to share information relating to another person or entity.

CGA and its professionals may prepare financial statements, project reports, CMA data, tax returns, GST returns, loan documentation, applications, registrations, legal documents and other deliverables in good faith on the basis of information and documents supplied by the client.

Any checking, verification or validation undertaken by CGA will ordinarily be limited to:

• The records, documents, explanations and figures supplied by the client;

• Public or third-party records reasonably available for the agreed work; and

• The verification procedures expressly included in the written scope of engagement.

Unless separately agreed in writing, CGA does not undertake an independent audit, forensic examination, investigation, physical inspection, asset valuation, title verification, credit appraisal or authentication of client-supplied documents.

The client must carefully review and approve every return, statement, calculation, application, report or filing before submission and must immediately notify CGA of any error, omission or change.

CGA may refuse, suspend or discontinue work where information appears incomplete, inconsistent, altered, unauthorised or potentially unlawful.

To the extent permitted by law, the client shall be responsible for any rejection, delay, additional tax, interest, penalty, regulatory action, credit decision, loss or third-party claim arising from inaccurate, forged, incomplete, concealed, misleading or late information supplied by the client.

Nothing in this clause excludes responsibility that CGA or its professionals cannot lawfully exclude, including responsibility for their own fraud, wilful misconduct, gross negligence or breach of mandatory professional duties.

5. No Guarantee of Results

CGA provides professional assistance and facilitation but does not guarantee:

• Approval, sanction or disbursement of any loan, credit card or credit facility;

• Any particular interest rate, credit limit, repayment period or financial term;

• Improvement, correction or removal of accurate information from a credit report;

• Approval of a tax refund, registration, licence, trademark, patent, ISO certification, government benefit or statutory application;

• A favourable assessment, appeal, court order, settlement, arbitration award or regulatory outcome;

• Funding, investment, profitability, business success or a particular financial return;

• Completion within a stated or estimated period; or

• Selection, employment, referrals, assignments or income through any career or empanelment programme.

All decisions remain with the relevant bank, NBFC, insurer, credit bureau, card issuer, government department, court, tribunal, registrar, certification body or other competent authority.

Words such as “fast”, “instant”, “best”, “easy”, “quick”, “same-day”, “minimum time” or similar expressions indicate objectives or possible processing experiences only. They are not unconditional promises.

6. Loans, Banking, Credit and Insurance

Unless specifically disclosed with applicable registration details, CGA is not a bank, NBFC, credit information company, credit card issuer, insurer, insurance broker, stockbroker or government lending authority.

CGA’s role is generally limited to consultation, documentation assistance, application support, referral or facilitation.

Loan approval, credit assessment, KYC verification, interest rate, Annual Percentage Rate, security requirements, fees and final contractual terms are decided exclusively by the concerned lender.

Empanelment with CGA does not grant any person CA, CS, advocate or other protected professional status.

Empanelled persons must accurately represent their qualifications and may perform only work legally permitted within their competence and authorisation.

Work requiring professional review, signature or certification must be handled by the appropriately registered professional.

Programme duration, compensation, assignments and working arrangements are subject to the applicable written offer or empanelment agreement.

No minimum referrals, earnings or continuation are guaranteed.

This indemnity does not apply to losses caused by CGA’s own fraud, wilful misconduct, gross negligence or non-excludable breach of law or professional duty.
